This User Agreement (hereinafter, the "Agreement") is an electronic contract between the User and IGM, and contains the rules of all IGM Products (the "Rules") at https://igm.games/ The Website administration reserves the right to update the text of the Agreement at its sole discretion. A new version of the Agreement will take effect immediately after it is posted on this page.
It is the User's responsibility to independently monitor new versions of the Agreement. By continuing to use the Website after the changes take effect, the User shall automatically accept the new version of the Agreement. If the User does not agree with the terms of the new version of the Agreement, he/she should inform us via support in order to deactivate his/her account.
This Agreement shall be deemed to be accepted by the user subject to the following conditions:
2.1. The value of Cryptocurrencies is highly volatile, the value can go up or down at any time, and may present a substantial risk that the User will lose money at the time of buying, selling, holding, staking or investing in the Cryptocurrencies.
2.2. The User should carefully examine the information on whether Cryptocurrency trading is suitable for him/her in light of his/her own financial condition and circumstances.
2.3. IGM does not own or control the underlying software protocols that govern Cryptocurrencies (except "IGM Cash"), generally the underlying software protocols are "open source" and anyone can use, copy, modify and distribute them.
2.4. The User assumes the risk and acknowledges that the underlying software protocols associated with any Cryptocurrency (excluding "IGM Cash") that the User stores in their IGM Xchange wallet may change.
2.5. In general, IGM is not responsible for any changes in the source code of Cryptocurrencies other than "IGM Cash (IGMC)" or changes in the source code of blockchain networks (such as TRC-20, BEP-20, etc.). Also, IGM is not responsible for the change in the value of any Cryptocurrencies.
2.6. Once a Cryptocurrency withdrawal has been requested from the User's account, IGM has no opportunity to cancel the transaction. The User, shall be solely responsible for any withdrawal transaction.
2.7. By opening an account with IGM, the User shall assume all possible risks of the Cryptocurrency market.
3.1. By registering on the Platform, the User represents and warrants that:
4.1. IGM hereby grants the User a personal, non-exclusive license to access the platforms and allows using the Services solely for the User's operations under this Agreement.
4.2. The User may not use any automated device, program algorithm or methodology, or any similar or equivalent manual process to access, acquire, copy or control any part of our websites, mobile applications or content, or in any way reproduce or circumvent the navigational structure or presentation of the websites, mobile applications, or any content in order to obtain or attempt to obtain any materials, documents or information through any means. IGM reserves the right to block any such activity.
4.3. The User must not attempt to gain unauthorized access to any part or feature of IGM Products, or any other systems or networks connected to IGM Products or any server on them, through hacking, password "mining" or any other illegal means, including use of virtual private networks or any other mechanism that would facilitate prohibited use/access to content or the Services.
4.4. The User must not investigate, scan or test the vulnerability of our services or any network connected to IGM Products, or violate security or authentication measures.
4.5. The User must not attempt to track any information about any other user or visitor to IGM Products, including any account on IGM products that not owned by the User.
4.6. The User must not use any device or software to interfere or attempt to interfere with the proper operation of our services or any transaction being conducted on IGM Products.
4.7. The User may not forge headers or otherwise manipulate identifiers to conceal the origin of any IGM Products' message or data transmission through IGM products.
4.8. The User may not use IGM Products for any purpose that is unlawful or prohibited hereby or request to perform any unlawful activity violating the rights of IGM or others.
4.9. The User agrees that IGM may, at its sole discretion and without prior notice, terminate access to its services and/or block future access to the User's IGM account if IGM determines that the User has violated the terms of this Agreement or other agreements that may be associated with the User's use of IGM Products.
4.10. The User agrees that any violation of the terms of this Agreement by the User will constitute an illegal and unfair business practice and will cause irreparable harm to IGM. IGM reserves the right to pursue any and all remedies.
4.11. The User agrees that IGM may, at its sole discretion and without prior notice, terminate access to the content or services when requested by law enforcement or other government agencies, or requested by the User (self- initiated account removal), as part of termination of or material change in services, or to correct a technical problem.
4.12. If IGM does take any legal action against the User as a result of the User's breach of this Agreement, the User agrees to pay all reasonable legal costs and expenses for such legal action, in addition to any other costs incurred by IGM.
4.13. The User agrees that IGM will not be liable to the User or any third party for termination of the User's access to IGM Products as a result of any violation of the terms of this Agreement.
4.14. The User agrees that, for security purposes, IGM might limit Cryptocurrency withdrawal from the User’s account, Cryptocurrency exchange in IGM Xchange and also using IGMC in IGM Products for a period of 24 hours.
5.1. IGM cannot guarantee the timely provision of the services because there are external factors that may affect the continued provision of the services. Nevertheless, IGM makes every effort to provide IGM Products 24/7.
5.2. IGM shall make a unique wallet address available for each account, so that the User can deposit Cryptocurrency into that account and withdraw from that account to an external wallet of the User's choice.
5.3. Any misrepresentation or fraudulent use of IGM account shall be considered a fundamental breach of the terms of this Agreement.
5.4. If IGM becomes aware or it is proven, in connection with trading activity, that the purpose of the User's account is to commit fraud, IGM will immediately suspend and block the User's IGM account.
5.5. IGM may, in its sole discretion, limit the number of accounts that the User may hold, maintain or purchase (with prior notice to User). The User is solely responsible for the password that the User assigns to the User's account, for its security and protection from disclosure.
5.6. The User must notify IGM immediately if the User discovers or otherwise suspects a security breach related to IGM products (In this case, at IGM's discretion, some IGMC will be credited to the User's IGM account as a reward).
5.7. The User is fully responsible for all activities related to the use of the User's Services, through his/her IGM account and/or using the password, as well as for the security of the User's computer systems.
5.8. The User acknowledges that he/she understands that transactions of a money laundering nature may be blocked.
6.1. The User can only deposit or withdraw supported Cryptocurrencies on supported blockchains. Be informed that depositing any unsupported Cryptocurrency or depositing supported Cryptocurrency on unsupported blockchain will result in a loss and IGM is not responsible for the application or return of such Cryptocurrencies.
7.1. Buyers and sellers of Cryptocurrencies and digital assets trade with each other, IGM is not a counterparty to any transaction the User makes.
7.2. IGM does not promise or warrant that the Services will be error-free or uninterrupted, or that any defects will be corrected, or that the User's use of the IGM Products will produce specific results.
7.3. IGM Products shall be provided on an "as is" and "as available" basis.
7.4. IGM shall not be responsible for any events beyond IGM's control, such as transactions processed through the blockchain for a particular digital asset. The User acknowledges and accepts that any transaction made in the blockchain is irreversible, the User is fully responsible for providing correct information about the recipient's wallet for the transfer of digital assets in IGM Products.
7.5. The User shall be solely responsible for the use of IGM Products, the User's actions, orders, transactions, submitted documentation, and general conduct.
7.6. By using IGM Products, the User expresses an acknowledgement of the risks, and IGM is entitled to assume that User has sufficient experience and knowledge to understand the risks associated with each transaction.
7.7. When a default event occurs, IGM may specify a date for termination and liquidation of all active orders ("Liquidation Date"). On or before the Liquidation Date, the User shall make any additional payments in accordance with the User's active orders. IGM may otherwise liquidate any open position to cover necessary payments.
7.8. If the User's trading activity is unusual or abnormal, IGM, at its discretion, has the right to stop processing the User's transactions until the situation is clarified, with a request for further verification or any other necessary documentation as may be required by law or agreement with counterparties.
10.1. Except where prohibited by law, in no event shall IGM be liable to the User for any indirect, consequential, exemplary, incidental or other damages, including loss of profits, even if IGM is notified of the possibility of such damages.
10.2. The User agrees to indemnify IGM, its officials, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates against any demands, losses, liabilities, claims or expenses, including legal costs, incurred by IGM from any third party in connection with use of the IGM Products.
11.1. This Agreement constitutes an electronic contract between the User and IGM with respect to the User's use of the Services, and any other written or oral agreements previously existing between the User and IGM with respect to such use are hereby superseded and cancelled.
